REPORTING YOUR INJURY IS THE FIRST STEP

Under California law, you have 30 days to report your injury to your employer. We recommend you report the injury as soon as possible, however. We understand that some injuries don’t show up immediately, and may take a few days to develop, but as soon as you realize that you have an injury, tell your immediate supervisor what happened and seek medical treatment right away. Be sure to choose the right doctor for your injury.

REQUIREMENTS FOR FILING YOUR CLAIM

The law requires your employer to give you (or mail you) a claim form called a DWC-1 within one day. If they do not give you the form, that could be a red flag, and you should contact an attorney right away. Likewise, call an attorney if you feel your employer is retaliating against you or threatens to fire you. In addition, you may decide you need an attorney’s help filling out the form. Once the form is complete, you file your claim by simply giving the form to your employer in person or mailing it through certified mail to ensure they receive it.
