Undocumented workers are generally eligible for workers’ comp. This is overwhelmingly the general rule across the country. With more than 8 million undocumented workers in the U.S., California and virtually every other state has given those workers the right to be eligible for workers’ comp benefits for job-related injuries. There are a few exceptions to this rule, such as possibly not being eligible for job retraining benefits if you are undocumented. But the basic point should be said again loud and clear: You can usually still get workers’ comp even if you are undocumented. Undocumented workers also generally have the same types of wage-and-hour law protections that apply to other workers. This is important to know if you work for an employer that is failing to follow federal and state protections for workers on issues such as overtime pay or minimum wage. Many undocumented workers work in dangerous jobs. A lot of undocumented people work dangerous jobs in construction, waste disposal and the underground economy. These jobs often have a lack of safety protections. This makes the availability of workers’ comp for injuries even more important.
