Here are three key things to know. Undocumented workers are generally eligible for workers’ comp. This is overwhelmingly the general rule across the country. With more than 8 million undocumented workers in the U.S., California and virtually every other state has given those workers the right to be eligible for workers’ comp benefits for job-related injuries.
